I have been writing Wills and Powers of Attorney for Eastbourne residents since the last century, but the business got a little to big for me, and I missed the chats with clients and getting right to the roots of what they needed to put into place. As the Sussex Regional Chairman of the Society of Will Writers and Estate Planning Practitioners, this question is far more important to the general public than they realise:
Why on earth would professional Will Writers need monthly updates?
This is why:
- Every week, judges make decisions that re-interpret or even change the law on estate planning.
- The government regularly tinkers with Estate Planning, trying to improve things with new documents, online access, reducing key staff, etc!
- The Taxman is always keen to try his or her luck at anything that might bring in more Inheritance Tax, so the rules are not as stable as you might expect.
- Above all, YOUR and your family’s circumstances are continually evolving.
- Marriages and separations, divorces, births, deaths, sex changes, windfalls and bankruptcies all mean that previously sound Estate Plans no longer do what you might expect, and that is before you take into account the previous four issues.
- So you think you know who your legal next of kin are? You could be in for a shock!
- People regularly make the lives of those left behind more complex than necessary and rack up lawyer’s fees needlessly.
- What happens if no will is found? Or a couple are not married? (Though there is a tiny bit of good news there.)

Asset Protection Eastbourne
Trusts are not the solution to all asset protection needs. In many cases, setting up a trust to protect against Care Fees is a self-defeating process.
There are sound reasons for setting up property trusts, but don’t be sold the idea that they are perfect for protecting against care fees.
Sometimes, just the adviser’s experience is enough, and a simple Will is adequate. Sometimes, relatively inexpensive Will Trusts are the best you can achieve—certainly if there is any element of poor health. At other times, when Care Fees are nowhere on the horizon and there are solid reasons to set up a property Trust, then they can be a useful tool.

I recommend that all Legal Plans should be reviewed no less often than every 3 years – and more often if circumstances change.
That doesn’t mean changes will be necessary – only that they might be. Missing out on those updates is going to give the Taxaman an unnecessary £140,000 in Inheritance Tax. Wirdly, it will be Tax Planning Wills which create the problem, as many will not have been reviewed.
Many firms write Wills and other documents that lack flexibility – for example, some will mean that you have to update them if you have another child, or that child will be left out. Someone reading this will be in that situation – unknowingly. As a Professional Will Writer, I will help if I can
